CONDITIONS OF PURCHASE FOR FOOD AND DRINK TICKETS

1. Purpose and acceptance

These Conditions of Purchase govern the advance purchase, through the platform set up for the Kilómetros por Investigar event, of tickets redeemable for food products, drinks or combinations of both (“bundles”) during the closing event.

Before completing the purchase, the user must read and expressly accept these Conditions of Purchase.

Making the purchase implies full acceptance of the conditions in force at the time it is made.

2. Participating entities

Hereinafter, “Madrid Chapter” or “the Organisation”.

Madrid Chapter is responsible for organising and holding the event and for those aspects directly related to it.

Technology platform and technical management of the payment

The platform used for the advance purchase of the tickets and the technical management of the payment process is provided by:

Hereinafter, “Bombyte”.

Bombyte takes part in the initiative as a collaborating and sponsoring entity, providing the technological infrastructure needed to manage the advance purchase of tickets and the electronic processing of payments.

Bombyte does not provide the catering service, does not prepare or supply the products purchased and is not responsible for the organisation or holding of the event.

Catering service provider

The preparation, handling, storage, supply and delivery of the food and drink products is the responsibility of:

Hereinafter, “Finca Solimpar” or “the Catering Provider”.

3. Available tickets

Different types of tickets may be purchased in advance through the platform for use during the event, including:

• Food tickets.
• Drink tickets.
• Packs or bundles combining food and drink.

The composition, content and price of each type will be shown to the user before the purchase is completed.

Purchasing a ticket entitles its holder to redeem it during the event for the products corresponding to the type purchased, in accordance with the conditions stated on the platform and with the availability planned for the event.

Tickets are valid exclusively for the event for which they were purchased and must be used within the times and period established for it.

Tickets are collected at the party counter by showing the QR code and may only be used during the food service of that edition.

Tickets may not be exchanged for cash or used outside the event.

Online ticket sales close 24 hours before the food service starts. After that moment no further orders can be placed.

4. Purchase and payment process

The user must select the tickets they wish to purchase, provide the data requested during the process and expressly accept these Conditions of Purchase before proceeding to payment.

The total amount of the purchase will be shown before the transaction is confirmed.

Payment will be made electronically through the Stripe payment gateway.

Once the payment has been correctly confirmed, the buyer will receive the corresponding proof of purchase, ticket, QR code, booking reference or validation mechanism established for redemption during the event.

Confirming the purchase entails an obligation to pay on the part of the user.

Should an incident arise relating exclusively to the operation of the platform, the generation or receipt of the ticket or the technical processing of the payment, the buyer may contact Bombyte at info@bombyte.es.

The confirmation email sent by Kilómetros X Investigar contains your QR code and the breakdown of your order. It is not a tax invoice.

5. Charitable purpose of the initiative

The advance sale of these tickets takes place within the framework of the charitable initiative Kilómetros por Investigar.

The funds or proceeds obtained through this initiative will be allocated to the charitable purpose linked to the project, once the costs, services, taxes, fees or other items associated with the transaction and with holding the event have been covered, where applicable.

Purchasing a ticket constitutes payment for the product or service associated with it and does not in itself constitute a direct donation made by the buyer, nor does it automatically give rise to any right to a donation certificate or tax deduction.

6. Responsibility for the food and drink

FINCA SOLIMPAR S.L.U. is the entity responsible for the preparation, production, handling, storage, safety, quality, supply and delivery of the food and drink products offered during the event, as well as for compliance with the health, food safety and consumer information regulations applicable to those products.

Bombyte merely provides the technological infrastructure used to make the advance purchase and to manage the payment technically.

Bombyte does not take part in the selection, production, preparation, handling, storage, transport or supply of the food and drink and is therefore not responsible for incidents arising from those activities where they are attributable to the Catering Provider.

Enquiries, incidents or complaints directly relating to:

• the composition or ingredients of the products;
• allergens or intolerances;
• handling or storage of food;
• quality or condition of the products;
• quantities or products actually served;
• food safety;
• possible adverse reactions;
• or any other matter directly related to the provision of the catering service,

All of the foregoing is without prejudice to the rights granted to consumers by the legislation in force and to the liabilities legally attributable to each of the participating entities.

7. Allergies, intolerances and food information

People with allergies, food intolerances or specific dietary needs must consult the relevant information with Finca Solimpar before consuming the products offered during the event.

Finca Solimpar, as the Catering Provider, is responsible for providing the mandatory information on ingredients, allergens and substances capable of causing allergies or intolerances, in accordance with the applicable regulations.

The advance purchase of a ticket neither implies nor guarantees the availability of specific products adapted to allergies, intolerances, special diets, food preferences or other particular needs, unless such availability is expressly stated in the description of the ticket purchased.

8. Availability and possible substitutions

For justified reasons of availability, supply, organisation or force majeure, certain products initially planned may be replaced by others of equivalent characteristics or value, always respecting consumer rights and the applicable regulations.

In any event, the information on ingredients and allergens must correspond to the product finally supplied.

9. Changes, refunds and right of withdrawal

The tickets sold are intended to be used during an event that will take place on a specific date or within a specific period and are linked to catering services and to a leisure activity with a specific date.

In the cases provided for by the legislation in force, this type of contract is excluded from the general fourteen-day right of withdrawal applicable to certain distance contracts.

Consequently, once the purchase has been correctly completed, no changes or refunds will be accepted on the grounds of being unable to attend the event, a change of mind or the buyer's personal circumstances, unless a refund is legally required or the Organisation expressly establishes more favourable conditions.

The foregoing does not affect the buyer's rights in the event of cancellation of the event, impossibility of providing the service purchased, incorrect charges, errors attributable to the system or any other situation in which a refund is legally due.

If you cannot attend the party, your tickets remain available for whoever brings your QR code.

10. Cancellation or modification of the event

The organisation and holding of the event are the responsibility of ASOCIACIÓN MADRID CHAPTER.

Decisions regarding its date, times, location, access, modification, suspension or cancellation rest with the Organisation.

In the event of definitive cancellation of the event, Madrid Chapter will determine the applicable measures in accordance with the legislation in force and, where legally due, the amounts affected will be refunded.

Where payments have been processed using the technological infrastructure provided by Bombyte, Bombyte may carry out the technical actions needed to execute the corresponding refunds.

Bombyte's involvement in the technical processing of a refund does not mean that Bombyte is responsible for the cancellation, modification or holding of the event.

11. Use and safekeeping of the tickets

The buyer is responsible for properly safeguarding the ticket, QR code, booking reference or proof of purchase received after the purchase.

Each ticket may only be used under the conditions established and will be considered used once it has been correctly validated or redeemed during the event.

The Organisation may reject tickets that are duplicated, forged, tampered with, fraudulently obtained or recorded as previously used.

In the event of a technical incident with a legitimately purchased ticket, the buyer may contact Bombyte at info@bombyte.es, providing the information needed to locate the transaction.

12. Complaints and incidents

In order to facilitate their proper resolution, incidents must be addressed to the entity responsible according to their nature.

The above distribution of channels is intended to ensure that each incident is handled by the entity responsible for the relevant service and does not limit the rights legally granted to consumers and users.

13. Data protection

The personal data provided during the purchase process will be processed in accordance with the Privacy Policy available on the platform and with the data protection legislation in force.

The data needed to make and manage the payment may be processed by the technology and payment service providers involved in the transaction, including Stripe, in accordance with their respective legal obligations and privacy policies.

The data provided to manage the purchase may also be used where necessary to identify the transaction, validate the tickets, handle incidents or process, where applicable, refunds relating to the purchase.

14. Applicable law

These Conditions of Purchase are governed by Spanish law.

Any dispute relating to their interpretation or application will be resolved in accordance with the legally applicable rules on jurisdiction and on consumer and user protection.

No provision contained in these Conditions is to be interpreted as a waiver or limitation of the rights mandatorily granted to consumers and users by the legislation in force.

15. Acceptance of the Conditions of Purchase

Before completing the purchase, the user must expressly tick the relevant box declaring that they have read and accepted these Conditions of Purchase.

The acceptance will be linked to the transaction carried out.

The applicable version of the Conditions of Purchase will be the one published and made available to the user at the time of the purchase.
